BoomCloud 360, a US-based audio technology firm, has filed a complaint seeking to block the import and sale of Apple, Google and Samsung phones in the United States, alleging those devices use three of its spatial audio processing technologies and a cloud-based sound optimization.
The company lodged the case in August under Section 337 of the Tariff Act of 1930 and is asking the United States International Trade Commission (USITC) to issue a Limited Exclusion Order that would bar the affected devices from US markets.
Samsung, a major global consumer electronics company, is among the targets; the complaint specifically references Galaxy phones and other devices. The filings also name phones from Apple and Google as using the contested technologies.
Spatial audio patent claims and targeted devices
According to the complaint, the alleged infringement involves three spatial audio processing technologies and a cloud-based sound optimization system developed by BoomCloud 360. The company requests USITC enforcement through a Limited Exclusion Order to prevent the importation and sale of devices it says incorporate those technologies.
The USITC will review the Section 337 complaint and the petition for an exclusion order; any decision on enforcement remains pending.
